TEX. BUS. & COM. CODE § 15.50 -- Many Non-Competes Still Not Enforceable
On April 17, 2009, the Texas Supreme Court issued its opinion in Mann Frankfort Stein & Lipp Advisors, Inc. et al. v. Fielding, that an at-will employee's non-compete promise may support a non-compete agreement. Bottom line: each entrepreneur or employee has the right to conduct business in the State of Texas. Understanding a non-compete agreement will give you the right to move on and continue to do business.
