Steele Sturm, PLLC achieved a significant victory in Texas on behalf of an insurance broker that previously worked for Gems and moved to Hays Group. At issue was the enforceability of a non-compete agreement in light of the Texas Supreme Court’s ruling in Alex Sheshunoff Mgmt. Servs. v. Johnson and the Houston Court of Appeals decision in Mann Frankfort Stein & Lipp Advisors, Inc. v. Fielding, 52 Tex. Sup. J. 616 (Tex. April 17, 2009), which loosens the requirements for enforceability.
Gems sought a temporary restraining order in Harris County district court. After oral argument by Howard Steele, Judge Rondon denied Gem’s request to restrict the employee from competing against his former employer.
