Steele Sturm, PLLC achieved yet another significant victory in Austin, Texas on behalf of an insurance broker that left Gallagher Healthcare, a subsidiary of Arthur J. Gallagher Co., the World's fourth largest insurance brokerage firm. At issue was the enforceability of a non-compete agreement that had been modified by Gallagher in an apparent attempt to comply with the Texas Supreme Court's ruling in Alex Sheshunoff Mgmt. Servs. v. Johnson. This decision has arguably loosened the requirements for enforceability of non-compete agreements in Texas.
On July 30, 2008, after oral argument by Howard Steele, the Court denied Gallagher's application for a temporary injunction (Gallagher was well represented by the Houston office of Seyfarth Shaw). The Court rejected Gallagher's argument that the revised agreement was reasonable under Texas law.
